Terms of Service

By creating an account, completing identity verification, or using any feature of Duovity, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use Duovity.

These terms constitute a legally binding agreement between you and Duovity. We may update these terms from time to time. Continued use of the service after updates constitutes acceptance.

Duovity is an interaction tracking and identity logging service. It allows users to:

• Verify their identity using a government-issued ID through a certified third-party provider
• Generate a verified QR card to share their identity before an interaction
• Create timestamped records of interactions with mutual consent
• Verify another person's identity in real time with their consent (Trust Scan)

You must be at least 18 years old to use Duovity. By using the service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You will provide accurate, truthful information
• Your use of Duovity will comply with all applicable laws and regulations

You agree to provide accurate and complete information when creating your account and completing identity verification. You are responsible for:

• Maintaining the security of your account and magic link sign-in
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at security@duovity.com

Identity verification is performed by Persona, a certified third-party provider. You authorize Duovity to share your information with Persona solely for the purpose of identity verification. You agree to Persona's terms and privacy policy in addition to ours.

Providing false identification or impersonating another person is a violation of these terms and may be illegal. We reserve the right to terminate accounts that provide false information.

When using Trust Scan to verify another person's identity, you agree to:

• Obtain the other person's explicit, informed consent before scanning their ID
• Use the Trust Scan feature only for lawful purposes
• Not scan anyone who has not freely and voluntarily agreed to be scanned
• Not use Trust Scan results to discriminate, harass, or harm the scanned person

You acknowledge that Trust Scan results reflect only that a document appeared authentic at the time of scanning. Duovity makes no guarantee that the result is accurate or complete.

You agree not to use Duovity to:

• Verify, scan, or track individuals without their knowledge and consent
• Discriminate against individuals based on any protected characteristic
• Stalk, harass, or intimidate any person
• Create false or misleading interaction records
• Impersonate another person or entity
• Circumvent or attempt to circumvent identity verification
• Use the service for any commercial surveillance purpose
• Violate any applicable local, state, national, or international law
• Interfere with or disrupt the integrity or performance of the service

Violation of these terms may result in immediate account termination and, where appropriate, reporting to law enforcement.

Records created through Duovity are timestamped logs of interactions. You understand and agree that:

• Records are stored on Duovity's servers and accessible by both parties to the interaction
• Records may be used as evidence in legal proceedings if required by law
• Duovity may disclose records in response to valid legal process, court orders, or governmental requests
• You will not create fraudulent or misleading interaction records

Duovity is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, error-free, or secure
• Warranties as to the accuracy of identity verification results
• Warranties that use of the service will prevent harm, loss, or damage

You use Duovity at your own risk. The service is a tool to document interactions and facilitate identity logging — it does not guarantee safety or the accuracy of any information provided by third parties.

To the fullest extent permitted by applicable law, Duovity and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or other intangible losses
• Damages arising from your reliance on identity verification results
• Harm caused by another user of the service
• Any matter beyond Duovity's reasonable control

Duovity's total cumulative liability to you for any claims under these terms shall not exceed the greater of: (a) the total amount you paid to Duovity in the twelve months prior to the claim, or (b) one hundred dollars ($100).

You agree to defend, indemnify, and hold harmless Duovity and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with:

• Your use of the service
• Your violation of these terms
• Your violation of any rights of another person
• Any interaction or transaction conducted through the service

Certain features of Duovity require payment. By making a purchase you agree that:

• All payments are processed by Stripe. Duovity never stores your payment details.
• One-time purchases (ID Verify, Trust Scans, Deep Check) are non-refundable once the verification or scan has been processed
• Subscriptions may be cancelled at any time. Cancellation takes effect at the end of the current billing period — no prorated refunds.
• Annual subscriptions are non-refundable after 14 days from purchase
• If a technical failure on our part prevents a verification from completing, we will issue a full credit or refund

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these terms. You may delete your account at any time by contacting privacy@duovity.com.

Upon termination, your right to use the service ceases immediately. Interaction records may be retained as required by law or for legitimate business purposes as described in our Privacy Policy.

These terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of Duovity shall be resolved through binding arbitration in Charleston, South Carolina, except that either party may seek injunctive relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Duovity.
